PARTICIPANT AGREEMENT, RELEASE, AND ASSUMPTION OF RISK 

This Participant Agreement, Release, and Assumption of Risk (“Agreement”) is entered into by and between RD&M Hospitality Group LLC, Escut Group, LLC, and Electric RYD, LLC, including their agents, owners, officers, volunteers, employees, affiliates, successors, assigns, and all other persons or entities acting on their behalf (collectively, “ERYD”), and the undersigned participant (“Renter”). 

By signing this Agreement, Renter acknowledges and agrees to the following terms: 

1. Assumption of Risk 

Renter understands that participation in electric scooter/mobility activities involves inherent and unforeseen risks, including but not limited to: 

• Collisions with scooters, vehicles, or stationary objects. • Falls, crashes, or accidents due to road conditions, weather, or environmental factors. • Equipment failure or malfunction. • Misjudgment by ERYD personnel regarding ability, fitness, or conditions. • Negligence by Renter or third parties. • Exposure to contagious illnesses or pathogens. 

Renter acknowledges that while ERYD personnel strive to promote safety, risks cannot be eliminated without altering the fundamental nature of the activity. 

2. Voluntary Participation 

Renter affirms that participation is voluntary and that they knowingly and willingly accept all associated risks. 

3. Release, Indemnification, and Hold Harmless 

 

Renter voluntarily releases, forever discharges, indemnifies, and holds harmless ERYD from any and all claims, demands, or causes of action related to injuries (including death), property damage, or other losses arising from participation. This includes claims alleging negligence by ERYD. 

4. Legal Fees and Costs 

Renter agrees to indemnify ERYD for all attorney’s fees and costs incurred in enforcing this Agreement. 

5. Insurance and Personal Responsibility 

Renter certifies they have adequate insurance to cover any injury or damages sustained while participating. If uninsured, Renter assumes full financial responsibility for any such costs. Renter further acknowledges responsibility for any medical or physical conditions. 

6. Jurisdiction and Venue 

Any claim or lawsuit against ERYD shall be filed exclusively in the State of Texas, and Texas law shall apply. If any provision is deemed unenforceable, the remaining provisions remain in effect. 

7. Damage Insurance and Responsibility for Damages 

a. If damage insurance is purchased, it applies only to the covered rental unit and does not extend to bodily injury or third-party property damage. b. Without insurance, Renter agrees to a minimum charge of $100 for any damages, up to the full replacement value of the unit. 

8. Theft, Loss, or Non-Return 

Renter accepts full responsibility for the replacement value of any rental unit that is stolen, lost, or not returned, ranging from $500–$1,500 per unit, as determined by ERYD. This charge is final, non-negotiable, and may not be disputed with a credit card company. Responsibility extends to all units rented under Renter’s name, including those used by guests. 

9. Safe Operation Guidelines 

Renter agrees to operate the scooter safely and in compliance with all applicable rules, including: 

• Wearing helmets and protective gear. • Following local traffic laws and regulations. • Not operating under the influence of alcohol, drugs, or impairing substances. • Avoiding reckless, negligent, or unsafe behavior. 

10. Towing, Impoundment, and Related Fees 

Renter is solely responsible for all towing, storage, and administrative fees resulting from: 

• Parking violations. • Operation in restricted areas. • Abandonment of rental units. • Law enforcement impoundment. 

A $250 impound fee will be assessed if a scooter is impounded due to Renter’s actions. 

11. Additional Terms 

a. Age Requirement – Renter must be at least 18 years old to enter into this Agreement and operate any rental unit. 

b. Passenger Restrictions – No toddlers or children unable to hold on safely may ride on two-seater scooters. Renter is fully responsible for ensuring passenger safety and compliance. 

12. Binding Effect for All Participants 

 

By signing, Renter accepts responsibility for ensuring all riders, payors, passengers, and license holders under their rental have read, understood, and agreed to this Agreement. Unless expressly rejected in writing prior to the rental, these terms are binding on all associated parties. 

This Agreement remains valid for all future participation with ERYD. 

13. Photography & Video Notice 

ERYD may photograph or record video during rentals, tours, or related activities for promotional, marketing, educational, or commercial purposes, including but not limited to use on social media platforms, websites, digital advertisements, printed materials, and other marketing channels. 

By participating in an ERYD rental, tour, or experience, Renter grants ERYD the irrevocable right and permission to capture, use, reproduce, publish, display, and distribute photographs, video recordings, or other media containing Renter’s image, likeness, voice, or appearance, without compensation or further approval. 

If Renter prefers not to appear in any photographs or video recordings, Renter must notify ERYD staff in writing at the time of rental or prior to participation. ERYD will make reasonable efforts to accommodate such requests but cannot guarantee exclusion from incidental or background capture in public environments. 

14. Curfew and Operating Restrictions 

Scooter rentals close at 8:00 PM. Riding any rental unit on public streets after 8:00 PM is prohibited due to the City of Houston curfew. Any citations, fines, tickets, impound fees, or other charges issued after 8:00 PM are the sole responsibility of the Renter, including all costs required to recover the scooter. 

This curfew is mandated under Chapter 45 of the City of Houston Code of Ordinances for the regulation of micromobility devices, effective November 10, 2025. 

15. Acknowledgment 

Renter affirms they have had sufficient opportunity to read this document, fully understand its contents, and agree to be bound by its terms.

In consideration of @full_name ("Minor") being permitted by ERYD to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless ERYD from any and all claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.
